1.2 Scope of Application

These Terms and Conditions (“Terms”) govern the use of the MyMovement Space platform (“Service”), including the website www.mymovement.space and the web application app.mymovement.space. By accessing or using our Service, you agree to be bound by these Terms.

1.3 Service Description

MyMovement.Space is a digital fitness and mobility training platform offering:

• Exercise video libraries

• Structured fitness and rehabilitation-supportive programs

• Progress tracking tools

• Professional training and educational content

⚠️ Important: MyMovement.Space does not provide medical treatment, physiotherapy, or healthcare services. The content is for educational and fitness purposes only.

2. User Registration and Account
2.1 Registration Requirements

• Users must be at least 16 years old

• Users must provide accurate and complete information

• Each user may only create one account

• Business accounts require additional verification

2.2 Account Security

• Users are responsible for maintaining the confidentiality of their login credentials

• Users must notify us immediately of any unauthorised account access

• We reserve the right to suspend accounts showing suspicious activity

2.3 Account Termination

Users may delete their account at any time through the settings page. Upon deletion, we will retain certain data as required by law (see Privacy Policy).

3. Paid Services and Subscription Terms

3.1 Available Programs

• Individual fitness programs: price is indicated on each program's page (one-time payment)

• Access includes lifetime access to purchased program content

• Prices include applicable VAT

3.2 Payment Processing

• Payments are processed through Stripe, a certified payment provider

• We accept credit cards and other payment methods as displayed

• All payments are processed in EUR

3.3 Right of Withdrawal (Widerrufsrecht)

According to § 312g BGB and EU Directive 2011/83/EU:

• Consumers have the right to withdraw from the contract within 14 days without giving any reason

• The withdrawal period expires 14 days from the day of contract conclusion

• To exercise the right of withdrawal, you must inform us by email with a clear statement

• If you request immediate access to digital content, you waive your right of withdrawal

3.4 Refund Policy

• Refunds for withdrawn contracts will be processed within 14 days

• We will use the same payment method used for the original transaction

• No refunds are provided after the withdrawal period or if immediate access was requested

4. Use of Service and Content

4.1 License Grant

Upon payment, users receive a non-exclusive, non-transferable license to access purchased content for personal, non-commercial use.

4.2 Prohibited Uses

Users may not:

• Share account credentials with others

• Download, copy, or redistribute video content

• Use the service for commercial purposes without authorisation

• Attempt to reverse engineer or hack the platform

• Upload malicious content or attempt to disrupt service

4.3 Health Disclaimer

• MyPhysio.Space content is designed for general fitness and preventive exercise.

• It is not medical treatment, physiotherapy, or healthcare advice.

• Always consult with qualified healthcare providers before starting any exercise program, particularly if you have pre-existing medical conditions or injuries.

• Stop exercising immediately if you experience pain, dizziness, or discomfort.

• We are not liable for injuries resulting from exercise performance.

5. Intellectual Property Rights

5.1 Platform Content

All content on MyMovement.Space, including videos, text, graphics, and software, is protected by copyright and other intellectual property laws.

5.2 User Content

By uploading content (if applicable), users grant us a worldwide, non-exclusive license to use, display, and distribute such content in connection with the Service.

5.3 Third-Party Content

Exercise videos are hosted on Vimeo and subject to their terms of service. Some content may be owned by third-party providers.

6. Data Protection and Privacy

6.1 GDPR Compliance

We process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). See our separate Privacy Policy for details.

6.2 Data Processing

By using our Service, you consent to:

6.3 Data Security

7.3 No Medical Services

Birken Sports UG does not provide medical services, diagnoses, or therapies.

The Service is fitness training support only.

For medical treatment, physiotherapy, or therapy, consult a licensed healthcare provider.

8. Indemnification

Users agree to indemnify and hold harmless Birken Sports UG from any claims arising from:

• Violation of these Terms

• Violation of applicable laws

• Infringement of third-party rights

• Injuries resulting from exercise performance

9. Modifications to Terms

9.1 Right to Modify

We reserve the right to modify these Terms with 30 days’ notice for existing users.

9.2 Notification

Changes will be communicated via:

• Email to registered users

9.3 Acceptance

Continued use after the effective date constitutes acceptance of modified Terms.

10. Dispute Resolution

10.1 Applicable Law

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict of law provisions.

10.2 Jurisdiction

The courts of Hamburg, Germany shall have exclusive jurisdiction for all disputes arising from these Terms, provided the user is a merchant, legal entity under public law, or has no general place of jurisdiction in Germany.

10.3 Online Dispute Resolution

According to EU Regulation No. 524/2013, we inform you about the online dispute resolution platform: https://ec.europa.eu/consumers/odr/

We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
